Court date set for Axl Rose's lawsuit against Guitar Hero

A court hearing on Tuesday (14th Aug) Saw Axl Rose's claim of fraud against games company Activision Blizzard tossed out, but his claim of breach-of-contract has been allowed to continue.

Rose and Black Frog Music claim that Activision Blizzard misled him into allowing 'Welcome to the Jungle' to be uses in the 2007 Guitar Hero game by stating that the game wouldn't feature any reference to Slash, the former GNR guitarist. The game featured an image of Slash on the front cover.

Rose's accusations have been weakened by the fact that he did not file the lawsuit until 2010, three years after the game's release. Activision's lawyers are claiming that Rose knew about Slash's inclusion, and yet waited three years to object, therefore he was too late to be within the statute of limitations.

According to Rose, he waited because:

"The reason I did not file a lawsuit is because Activision -- through my managers and representatives -- offered me a separate video game and other business proposals worth millions of dollars to resolve and settle my claims relating to GHIII. From December 2007 through November 2010, Activision was offering me a Guns N' Roses dedicated video game, a game dedicated to music from the 'Chinese Democracy' album, and other proposals."

These events have lead to a potential trial being held next February.
