The ex-wife of Van Halen's drummer Alex Van Halen is being sued for using the famous surname for 'commcercial purposes'.
Alex married Kelly Carter in 1984, before they later divorced in 1996. However, Billboard reports that she'll be taken for court for still using the name 'Kelly Van Halen'.
ELVH Inc own the intellectual property rights for the band - which was named after founding members guitarist Eddie and drummer Alex. They're suing Kelly Van Halen in a California federal court for 'using her name in trade'.
It is claimed that Kelly Van Halen has named her construction and interior design company after herself, with ELVH now calling her out for 'trademark infringement'.
