Earlier this year Lady Gaga was sued by her former assistant, Jennifer O'Neill, but it seems that they have both settled their differences and neither woman will have to attend the court date in New York next month.

O'Neill claimed that she was cheated out of overtime wages when she worked for the popstar for a few weeks in early 2009, and for the 13 months beginning in Februrary 2010; it was revealed on Monday that the case was being dismissed.

Court papers revealed that Gaga and O'Neill were roomates and friends, where they both lived on the Lower East Side of Manhattan, before 2008.

O'Neill was paid at a flat rate of about $50,000 annualy when she was first hired, and then when she worked with Lady Gaga the second time she earned $75,000 annually.

O'Neill monitored the popstar's communication, handled up to 20 bags of her luggage, and even frequently slept in the same bed as Gaga whilst they were touring.

The District Judge Paul G. Gardephe ordered the case to proceed to trial, as he felt that O'Neill was "on-call" 24 hours a day 7 days a week.

Lady Gaga, birth name Stefani Germanotta, testified "You don't get a schedule. You don't get a schedule that is like you punch in and you can play...at your desk for four hours and then you can punch out at the end of the day. This is when I need you, you're available."
