Topshop's appeal against the ban on their sale of the Rihanna-printed t-shirt has dismissed, after a court ruled that marketing the t-shirts without RiRi's approval is in violation of the singer's rights.
Appeal judges dismissed Topshop's appeal against the ban on their use of Rihanna's image, stating that the original judge "was entitled to find that the sale by Topshop of the T-shirt amounted to passing off" (a term used to describe unlawful misrepresentation of a brand).
According to The Independent, Topshop's lawyer urged the court that the tank tops were in a tradition of musicians' images being used on clothes, such as Elvis Presley, Jimi Hendrix and Prince. The judge said that the brand's use of her face on the t-shirt was damaging to Rihanna's 'goodwill', as her fans would be misled into thinking she had authorised the use of the image.
The t-shirt sported a photo of Rihanna on the set for a music video in 2011, on a white background.
Rihanna has reportedly been in the studio working with DJ Mustard, Ester Dean, and Ne-Yo, among others on the follow-up to 2012's Apologetic. Calvin Harris revealed recently that currently he is not featured on the album.
Rihanna herself told the New York Times: "I can't give you any hints of when it will drop. It's going to be great, that's all I'm going to tell you and I'm excited about it. I try to battle myself and outdo everything I've done and that's been the hardest thing to do. You start overthinking things at times."
A supposed tracklisting for an album called Lost Files was also doing the rounds online last month, featuring Drake, Nicki Minaj, Big Sean and Eminem.
